Music listened on radio and music on hold is first recorded. Then delivery medium is provided where the music becomes a performance. In countries where copyright laws are enforced nearly every recording of a song title holds its own copyrights. For example when a song title is broadcasted on telephone music on hold then said use must be approved and licensed from both the "song title" copyright owner and the "mechanical" copyright owner. Generally it is known within the on-hold industry that some performance rights societies, with regional offices and staff, both monitor and prosecute persons and businesses that infringe on the copyright of title holders in their libraries. The agencies are aggressive about this, from time to time. No one knows whether any record companies are currently or actively monitoring and prosecuting violators of their mechanical license. It is advised that their current disinterest or inactivity regarding protection of their rights should not be misunderstood as permission to infringe on their mechanical copyrights.

The industry of music on hold advises all people providing music to their music on hold, to act in a lawful manner regarding all applicable copyrights and laws. The copyright office clearly summarizes United State’s Copyright law when it says, that names, titles, and short phrases or expressions are not subject to copyright protection. That is even if a name, title, or short phrase is novel or distinctive or if it lends itself to a play on words, it cannot be protected by copyright. The arrangements of music that are done are purposely simple but enticing and don’t over shadow any automated voice over messages. Even the instruments in our music on section are chosen specifically to sound good on a telephone handset. The sound previews are low quality examples like the music quality depends on when the music was uploaded. Also pre broadband files sound worse than the higher bit rate which is used now days.
