Patients often sue physicians and hospitals claiming medical negligence when they don’t have the surgical outcome they expect. In many of these instances, no medical negligence exists; it is just the best result that could be obtained for that particular patient considering their condition. However, that is not always the case. For instance, I recently read in the news an article from MSNBC News concerning operating room fires. This article stated that the incidence of operating room fires probably occurs between 550 to 650 times a year.

Yet this has gone relatively unnoticed in the news. Pennsylvania now requires hospitals to report incidents of operating room fires and their records have indicated that fires occur in one of 87,646 patients in 2007. That amounted to 28 fires in Pennsylvania alone! I believe this indicates a greater incidence of operating room fires that anyone could ever imagine. Does this indicate hospital negligence? Or does it indicate physician negligence? Often times, it is physician negligence.

Flash fires in the operating room can occur when an electrosurgical tool comes too close or into to contact with the patient’s oxygen mask, or the paper drapes around the surgery site. There are other causes of operating room fires but these are the majority. Patients often sue physicians claiming clinical negligence when they believe the physician misdiagnosed them or failed to diagnose a serious condition. And then there are lawsuits against physicians instigated by attorneys who encourage their clients to pursue the claim.

This is a litigious society and people will try to collect a compensation claim for any little thing they can. In many cases, however, medical negligence does happen and people should consider making a compensation claim in these instances. Medical staff should not be allowed to get away with letting you down if it involves your health.
